Jega Mahmud, a political analyst, has spoken about the decision of the Rivers State House of Assembly, led by Martin Amaewhule, to adjourn indefinitely. He explained that this move could disrupt governance in the state and urged Governor Siminalayi Fubara's legal team to take action.
Speaking in an interview with News Central TV, Mahmud said that by going on an indefinite recess, the lawmakers were preventing the normal functioning of the government. He stated that Governor Fubara's legal team should carefully examine the Nigerian Constitution, particularly Section 11, subsections 4 and 5, to find a legal solution to the problem. He said one possible step would be to involve the National Assembly. He said the law allows the National Assembly to take over the duties of a state assembly if the state legislature is unable to function properly. He emphasized that this would ensure that governance in Rivers State continues smoothly until the state lawmakers decide to return from their recess.
In Mahmud's words: "I think it is high time the Fubara legal team should sit up and look at the provisions of the constitution. Because for them to have arjourned sine die they are stopping the running of governance in that state. And I think basically Governor Fubara's legal team can activate section 11 subsection 4 and subsection 5 of the constitution of the Federal Republic of Nigeria, to see that the National Assembly take over the proceedings of the State House of Assembly for the purpose of smooth governance in the state till when the House of Assembly decide to come from their indefinite recess. Because they cannot hold the state to ransom or stop it from running in a constitutional way and manner"
