A Zimbabwean man from Nyanga, who turned violent and heavily assaulted his wife after she refused to be intimate with him in the presence of their six year-old child has been slapped with a three-month jail term.
According to Manica Post, Fungai Bhayi (31) from Manhare Village under Chief Chikomba appeared before Nyanga magistrate Mrs Gloria Takundwa facing domestic violence charges.
He pleaded guilty to contravening Section 3 (1) (a) of the Domestic Violence Act.
Mrs Takundwa, however, gave him an option to pay $200 fine.
Public prosecutor, Mr Kelvin Mufute, told the court that the crime was committed on August 21.
"On the day in question at around 5.30am, the accused person had a misunderstanding with the complainant while they were in the bedroom. The accused person was demanding to be intimate with his wife in the presence of their six-year-old child who was awake. The complainant refused, resulting in the assault," said Mr Mufute.
Bhayi assaulted her with a bamboo stick on her right ribs and head butted her on the mouth resulting in her sustaining serious injuries.
"The complainant managed to open the door and fled into the darkness, leaving the accused person in the bedroom."
The matter was reported to the police resulting in Bhayi's arrest. He pleaded for leniency saying he acted out of anger.
